Protecting your inheritance during divorce

If you are going through a divorce, you know the number of difficulties during divorce is large, and what this process requires is so much of us as persons and you may be figuring out how to move forward.

Here are some questions to ask yourself if you have an inheritance:

  1. Is your inheritance separate from the marriage money?
  2. Did you ensure the assets are all only in your name?
  3. Did you deposit the money in a separate bank?
  4. Did I speak with an attorney to make decisions?
  5. Did you go over your prenuptial agreement?
  6. Did you create a trust to protect your assets?
  7. Are you remaining informed on the matter?

As you can see, protecting your inheritance has a lot to do with keeping it separate. Clients ask when inheritances have problems, and the answer is when they are so mixed up with the other party (commingled) that the court must subject them to distribution according to the state’s laws of property division.

Another important aspect to consider is whether you have a prenuptial agreement. Whether you do or not, it is not too late to protect your assets, and you should speak with an attorney right away.
